Terms of Service

These Terms of Service ("Terms") govern your use of the SkimGuard mobile application and related services ("Service") operated by SkimGuard, Inc. ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Description of Service
SkimGuard is a consumer safety application that uses Bluetooth scanning (Bluetooth Low Energy and Bluetooth Classic) to detect potential credit card skimming devices at payment terminals. The Service includes a mobile application and a public safety map, free for all consumers.
2. Eligibility
You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.
3. Account Registration
You can use the app without an account. Creating an account is optional — it lets you keep your scan history if you reinstall or switch devices — and uses email, Google, or Apple sign-in. You are responsible for maintaining the security of your account credentials.
4. Consumer Access and Pricing
The SkimGuard consumer app is free. All detection features, the public safety map, and your scan history are available at no cost — there is no subscription, free trial, or advertising in the consumer app. Business accounts are subject to separate paid subscription terms, described in Section 7.
5. Acceptable Use
You agree not to:
- Use the Service to harass, defame, or harm others
- Submit false or misleading skimmer reports
- Attempt to reverse-engineer, decompile, or tamper with the application
- Use automated tools to access the Service (except authorized API clients)
- Circumvent technical access controls or usage limits
- Use the Service for any unlawful purpose
6. User-Generated Content
When you submit skimmer reports or scan feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, aggregate, and display this data for the purpose of improving the Service and generating safety ratings. Reports are subject to moderation and credibility scoring.
7. Business Accounts
Business accounts are subject to separate subscription terms based on the number of enrolled locations. Business users may enroll hardware devices and roaming employee devices to scan on behalf of the business. API access for data licensing is governed by a separate Data Processing Agreement.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. SkimGuard is a detection aid, not a guarantee of safety. A "clean" scan result does not guarantee the absence of skimming devices. A "suspicious" result does not confirm the presence of a skimmer. Always exercise caution when using payment terminals and report suspicious activity to local authorities.
We do not guarantee the accuracy, completeness, or timeliness of location safety ratings, which are based on crowd-sourced data and automated analysis.
9. Limitation of Liability
To the maximum extent permitted by law, SkimGuard, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to financial losses from credit card fraud.
10. Indemnification
You agree to indemnify and hold harmless SkimGuard, Inc. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your account for violation of these Terms or for any reason with reasonable notice. You may delete your account at any time from the app's Settings or at skimguard.io/deleteme.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
